Terms of Service

These Terms of Service ("Terms") apply when you use this website, request a consultation, or buy any service from ACG Foundation. Please read them before you order. By ticking the box at checkout, or by asking us to start work, you agree to these Terms, our Refunds & Cancellation Policy and our Privacy Policy, which form part of them.

1. Who we are

ACG Foundation ("ACG", "we", "us", "our") is a web design and digital marketing studio based in Morocco. We are the supplier of every service sold on this website and are responsible for delivering it, for customer support and for refunds. Contact: hello@acg.foundation.

"You" means the person or business ordering. If you order for a business, you confirm you are allowed to bind that business to these Terms. You must be at least 18 years old to buy from us.

2. Payments are processed by Whop

  • Payments are processed by Whop, which acts as merchant of record solely in its capacity as payment processor and for card-network purposes. Whop is not the seller of our services and is not responsible for delivering them.
  • When you pay, Whop's Buyer Terms and privacy policy also apply to the payment itself. Your bank statement may show Whop as the payment processor; your receipt shows ACG Foundation as the supplier.
  • We never see or store your full card details. Card data is handled by Whop and its payment partners.
  • Questions about the service, refunds or cancellations go to us. Questions about the payment itself (for example a duplicate or unrecognised charge) can also go to Whop support.

3. How ordering works

  1. Build your plan. You choose services on our pricing page and tell us about your business.
  2. Pay now, or talk first. You can pay straight away through Whop's secure checkout, or request a free consultation call first. A consultation is free and does not commit you to anything; nothing is charged until you pay through checkout.
  3. Kickoff. After payment we email you to book a short kickoff call (by Zoom or similar) and confirm what we need from you.
  4. Delivery. We deliver within the time stated for each service and confirm delivery in writing by email.

A contract is formed when your payment is confirmed. We may decline an order before work starts (for example if the business is not one we can serve under section 9); if so, we refund you in full.

4. Prices and taxes

  • Prices are shown in US dollars on our pricing page and on each service page. The price shown at checkout is the price you pay for that order; we honour it once you have paid.
  • Monthly prices apply per month. With annual billing, monthly services are billed once a year at a 20% discount.
  • Taxes such as VAT or sales tax may be added at checkout where the law requires it. Your bank may charge its own currency conversion or foreign transaction fees, which we do not control.
  • If we change a price, the new price applies to new orders. For an existing subscription, we email you at least 30 days before a new price applies to your next renewal, and you can cancel before it does.

5. What each service includes, and when it is delivered

Each service page describes exactly what is included and how it is delivered. Anything not listed is not included unless we agree it in writing (email counts). In summary:

  • How delivery works. We deliver by publishing work to accounts in your name (your domain, website, Google profile, social profiles, email platform) and by sending files and log-in hand-over notes by email. We confirm each delivery in writing.
  • Timing. Delivery windows start from the kickoff call and assume we receive the information, content and access we ask for. If we are waiting on you, the date moves back by the same amount of time. If we cannot start because we have heard nothing from you for 60 days after payment, we will email you; the refund rules in our Refunds policy then apply.
  • Revisions. Each one-time service includes reasonable revisions within its scope, agreed by email or on a call. New pages, features or a change of direction after approval are extra work, which we quote first.
  • No lifetime promises. One-time services are delivered once. Ongoing support, hosting and changes after delivery are covered only by an active monthly service.

6. Monthly services (subscriptions)

  • Monthly services renew automatically at the end of each billing period (each month, or each year with annual billing) at the price shown at checkout, until you cancel.
  • Cancel anytime, with no contract and no cancellation fee: use the cancel link in your Whop receipt or account, or email hello@acg.foundation. Cancelling stops the next renewal; the service continues until the end of the period you have already paid for.
  • We ask for 14 days' notice where possible so we can hand everything over cleanly, but notice is a request, not a condition. We never charge you after you cancel.
  • If a renewal payment fails, Whop may retry it. If it still fails, we pause the service until payment is made or you cancel.

7. Refunds and your right to withdraw

Our Refunds & Cancellation Policy explains when you get money back. In short: a full refund before the kickoff call, a refund for work not yet started after kickoff, and revisions rather than refunds for delivered work. Refund decisions are made by us; approved refunds are returned to your original payment method through Whop.

Customers in the EU, EEA and UK who buy as consumers may withdraw within 14 days of purchase. If you ask us at checkout to start work within those 14 days, you will pay for work already done if you withdraw, and you lose the right to withdraw once the service has been fully performed. Nothing in these Terms limits your statutory consumer rights.

8. You own what we make

  • Once an order is paid, you own the deliverables we create for you: designs, logos, written copy and website files. We assign to you any rights we hold in them.
  • Accounts (domains, hosting, website, social profiles, email platforms, Google profile, payment accounts) are set up in your name wherever the provider allows. You keep them if you stop working with us.
  • Third-party items (fonts, stock photos, plugins, platforms and templates) remain subject to their own licences and terms, which we tell you about.
  • We may keep copies for our records. We show your work in our portfolio only with your written permission.
  • Our own know-how, tools, processes and reusable code stay ours; you receive a perpetual licence to use any of them included in your deliverables.

9. What we don't do, and businesses we can't serve

To keep within the law and our payment processor's rules, we do not:

  • sell fake followers, likes, reviews or engagement, or any growth package that inflates numbers;
  • scrape or sell personal data, or build data-scraping tools;
  • provide legal, tax, financial or investment advice, or write contracts or legal documents for your business;
  • run outbound cold-calling (telemarketing) or send unsolicited bulk messages;
  • promise or guarantee specific results, such as sales, income, leads, followers or search rankings;
  • publish claims we know to be false or misleading, including unrealistic income or earnings claims.

We may decline or stop work, with a refund for work not yet done, for businesses or content that are illegal, deceptive, infringe someone else's rights, or fall within Whop's prohibited products and services, including financial services that need a licence, gambling, adult content, weapons and pyramid schemes.

Because of sanctions and our payment processor's coverage, online checkout is not available in some countries (including Cuba, Iran, Iraq, Libya, North Korea, Palestine, Sudan, Syria and Yemen, among others). If checkout is unavailable where you are, please email us.

10. Your responsibilities

  • Give us accurate information and the content and access we need, on time.
  • Only give us content (text, logos, photos, trademarks) that you own or have permission to use. You are responsible for claims that your content infringes someone else's rights.
  • Review and approve work before it goes live. You are responsible for the products you sell, the claims you make, and your business's licences, permits and legal pages.
  • Keep your account log-ins safe. Change any passwords you shared with us once the work is finished.

11. Confidentiality

We keep your business information and log-ins confidential and use them only to deliver your services. We ask for the minimum access we need.

12. Third-party platforms

Your website and marketing rely on third-party platforms (for example domain registrars, hosting providers, Google, Meta, TikTok and email providers). They control their own rules, approvals, outages and price changes. We are not responsible for their decisions, such as a rejected profile or a changed algorithm, but we will help you deal with them within the scope of your service.

13. Problems with a payment

If something is wrong with a charge or with our work, please email us first. We reply within two business days and can usually fix it, or refund under our policy, faster than a bank dispute. Opening a chargeback does not affect your rights, but we may pause work on a disputed order while it is open, and we share our order records, these Terms and delivery confirmations with Whop as evidence.

14. Liability

  • We deliver our services with reasonable care and skill. Apart from that, and to the extent the law allows, services are provided without further warranties.
  • We are not liable for loss of profits, revenue, data or business opportunities, or for indirect losses.
  • To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the service concerned in the 3 months before the claim.
  • Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

15. Ending our work together

You can stop at any time as described in sections 6 and 7. We may stop working with you if you seriously or repeatedly breach these Terms (for example, by not paying, by asking us to do something in section 9, or by abusive behaviour), after telling you why. In that case we refund any paid work not yet started and hand over everything already delivered.

16. Events outside our control

We are not responsible for delays caused by events outside our reasonable control, such as platform outages, internet failures, illness or natural events. We will tell you promptly and agree a new date, or refund work not yet started if you prefer.

17. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order applies to that order. For subscriptions, we email you at least 30 days before material changes apply to your next renewal.

18. Law and disputes

These Terms are governed by the laws of Morocco. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts. We will always try to resolve a complaint informally first: email hello@acg.foundation.
